DMCA Policy

Koud Bloed Podcast respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website, Koud Bloed Podcast will respond expeditiously to claims of copyright infringement committed using the Koud Bloed Podcast service that are reported to our designated Copyright Agent.

This page describes the information that should be present in a DMCA Notice and a Counter-Notification. We suggest that you consult with your legal counsel before filing a notice or counter-notice.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Koud Bloed Podcast service by completing the following DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent.

Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail, such as the title of the copyrighted work, author, and any registration numbers.
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled: Include the specific URL(s) or other identifying location of the material on Koud Bloed Podcast that you claim is infringing, for example, a direct link to the episode, podcast feed, or specific timestamp within an episode.
Information reasonably sufficient to permit Koud Bloed Podcast to contact the complaining party: This includes your name, address, telephone number, and email address.
A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material and notify the alleged infringer. We may also terminate the accounts of repeat infringers.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated Copyright Agent. The Digital Millennium Copyright Act allows us to restore the removed content if the party filing the original DMCA notice does not file a court action against you within 10-14 business days of receiving the counter-notice.

A counter-notification must include the following:

Identification of the material that has been removed or to which access has been disabled: Include the specific URL(s) or other identifying location of the material on Koud Bloed Podcast and where the material appeared before it was removed or disabled.
A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
The subscriber's name, address, and telephone number.
A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located: If the subscriber's address is outside the United States, for any judicial district in which Koud Bloed Podcast may be found.
A statement that the subscriber will accept service of process from the person who provided the original DMCA notification or an agent of such person.
A physical or electronic signature of the subscriber.
